1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of PodKit (the "Service"), operated by Medeu Zhaksilikov ("PodKit," "we," "us," or "our"), available at podkitapp.com and via our API. By creating an account, obtaining an API key, or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service.
2. What PodKit Is
PodKit provides programmatic access to podcast data — search, show and episode metadata, chapters, and transcripts — via a REST API and an MCP (Model Context Protocol) server, for use by developers, no-code automation platforms (e.g. Zapier, Make, n8n), and AI/agent applications.
PodKit aggregates and normalizes data from third-party sources, including the Apple iTunes Search API, the Podcast Index API, and podcast RSS feeds published by independent podcast creators and networks. PodKit does not create, own, or control this underlying content, and is not responsible for its accuracy, completeness, or availability. Podcast audio, transcripts, and associated metadata remain the property of their respective creators and publishers.
3. Accounts and API Keys
- To use the Service beyond public/unauthenticated pages, you need an API key, obtained either via our free-tier signup or by subscribing to a paid plan through checkout.
- API keys are shown to you once at creation or rotation. We store only a cryptographic hash of your key, not the raw value — we cannot retrieve or re-display a lost key. If you lose your key, you can request a new one via our key-recovery flow, which invalidates the old key.
- You are responsible for keeping your API key confidential and for all activity under your key. Do not embed API keys in client-side code, public repositories, or any context accessible to third parties.
- You may not share, sell, sublicense, or transfer your API key to another party.
4. Plans, Quotas, and Fair Use
- We offer a free tier and paid subscription tiers, each with a monthly request quota and reasonable per-minute rate limits, as described on our pricing page.
- Exceeding your plan's monthly quota will result in requests being rejected until your quota resets or you upgrade. Exceeding short-term rate limits will result in temporary throttling.
- We reserve the right to change plan quotas, rate limits, and pricing for future billing periods, with reasonable notice.
- You agree not to attempt to circumvent quotas or rate limits (e.g., via multiple free accounts, credential sharing, or automated abuse).
5. Acceptable Use
You agree not to use the Service to:
- Re-sell, redistribute, or offer the raw data returned by the API as a competing, substantially similar data product or dataset, without our written permission.
- Scrape, probe, or attempt to extract data from the Service through means other than the documented API/MCP interface.
- Interfere with, disrupt, or attempt unauthorized access to the Service, its infrastructure, or other users' accounts or data.
- Use the Service for any unlawful purpose, or to transmit malware, or to violate the intellectual property or privacy rights of any third party, including podcast creators whose content is surfaced through the Service.
- Misrepresent your identity or the source of your API traffic.
We reserve the right to suspend or terminate access for violations of this section, with or without notice, at our discretion.
6. Billing and Payments
- Paid subscriptions are billed and processed by Polar Software, Inc., acting as merchant of record. Polar handles payment collection, applicable tax calculation, and payment method storage — PodKit does not directly receive, process, or store your payment card details.
- Subscriptions renew automatically each billing period until canceled. You authorize recurring charges at the price shown at checkout.
- You can manage or cancel your subscription through the customer portal link provided at checkout or upon request to support@podkitapp.com.
- Refunds, if any, are subject to Polar's buyer terms and our discretion on a case-by-case basis; contact support to request one.
7. Intellectual Property
- PodKit and its underlying software, branding, and documentation are owned by us and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding beyond what's needed to reasonably describe your use of the Service (e.g., "Powered by PodKit").
- You retain all rights to applications, products, or content you build using data obtained through the Service, subject to the underlying rights of the original podcast creators in that data (see Section 2).
8. Service Availability and Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not guarantee uninterrupted, error-free, or continuous availability of the Service, and downstream data sources (iTunes, Podcast Index, individual RSS feeds) may themselves be unavailable, incomplete, or inaccurate from time to time, which can affect Service output.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PODKIT AND ITS OPERATOR(S) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, engage in abusive behavior, or if required by law. Upon termination, your right to use the Service ends immediately; provisions of these Terms that by their nature should survive (e.g., Sections 7, 8, 9) will continue to apply.
11. Changes to These Terms
We may update these Terms from time to time. We'll post the updated version on this page with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law principles.
